These terms and conditions govern participation in the photo competition "Show us your Alfsee!" (hereinafter referred to as the "photo competition"). Participation is free of charge and is governed exclusively by these terms and conditions.

Participation is exclusively via the upload form at https://www.alfsee.de/foto-contest

For valid participation, all information marked as mandatory must be submitted completely and truthfully within the participation period, at least one acceptable photo must be uploaded, and the required declarations must be submitted. The date of complete receipt by Alfsee is decisive. Submissions via other means will not be considered.

Only one entry per person is permitted, with a maximum of five photos in total. Multiple submissions may be combined or excluded.

3. Eligibility

Natural persons who are at least 18 years old at the time of participation and have a residence in Germany are eligible to participate. Participation is not contingent upon a booking, a purchase, or any other paid service.

Excluded from participation are individuals directly involved in the conception, organization, technical execution, or evaluation of the photo competition, as well as their family members living in the same household. Other employees of Alfsee GmbH may participate, provided they are not involved in the execution or evaluation.

4. Subject and categories

We are looking for photos taken by the entrants themselves, no more than two years old, with a clear connection to the Alfsee Holiday and Adventure Park or to holiday moments experienced there. Submissions are welcome across all categories. Judging will take place in the following categories:

5. Requirements for submitted photos

Only photographs taken by the participant themselves and for which they possess the necessary copyright and usage rights are permitted. In particular, the photograph must not infringe any copyright, trademark, design, property, ownership, personality, or data protection rights of third parties.

Acceptable file formats: JPG/JPEG/PNG/HEIC; maximum file size: 20 MB per photo, max 50 MB per entry.

The following are specifically not permitted:

• Photos without any discernible connection to Alfsee;

• unlawful, dangerous, violence-glorifying, pornographic, discriminatory, insulting or otherwise grossly offensive content;

• Photos with recognizable persons if the necessary consents for submission, jury review and, if applicable, publication are not demonstrably available;

• Photos containing recognizable minors are not permitted unless all necessary consents from the legal guardians and – depending on age and capacity for understanding – the child are obtained;

• Images generated entirely or partially by generative AI or manipulated by AI in essential image components;

• Photos with watermarks, foreign logos, conspicuous lettering or highly distorting design elements;

• Content submitted automatically or using sweepstakes or manipulation services.

Standard photographic corrections, such as adjustments to brightness, contrast, color, sharpness, white balance, or cropping, are permitted, provided the documented content is not significantly altered or distorted. For selected images, Alfsee may request the original file or a higher-resolution version, along with appropriate proof of rights and consent.

6. Rights and declarations of the participating person

By submitting their entry, the participant confirms that their information is correct, that they took the photo themselves, that they have the necessary rights to participate, and that the submission does not infringe any third-party rights.

If individuals are recognizable, the participant must obtain their informed consent before uploading the image to Alfsee, for its review by the jury, and for the publication and promotional use described in section 7. In the case of minors, all necessary consents from their legal guardians and – depending on their age and capacity for understanding – also from the child must be obtained. The consent must cover the specifically described advertising purposes and media. Alfsee GmbH may request corresponding proof and block or exclude the photo until such proof is provided.

The participating person shall indemnify Alfsee GmbH against any legitimate claims by third parties arising from a breach of the aforementioned warranties caused by their culpable conduct. This indemnification includes the necessary and reasonable costs of legal defense. Further statutory rights remain unaffected.

7. Comprehensive usage rights to all valid submissions

Under German law, copyright remains with the photographer. However, by participating, the participant grants Alfsee GmbH, free of charge, the exclusive, geographically unlimited, and temporally unlimited right to use each validly submitted photograph for the purposes and types of use described below. This grant of rights applies regardless of whether the photograph is selected as the winning entry.

Alfsee GmbH is permitted to use the photos for its own advertising, public relations, image communication, and presentation of its offers, facilities, and events. This includes, in particular:

• existing and future websites, landing pages, apps and online booking offers of Alfsee GmbH;

• own profiles and paid advertisements on social networks;

• digital ads, search engine advertising, online banners and other online marketing;

• Newsletters and other electronic customer communications;

• Alfsee GmbH's profiles on external service providers such as booking.com or Pincamp

• digital screens, displays and information systems at Alfsee GmbH locations;

• Posters, flyers, brochures, advertisements, catalogues, mailings and other printed advertising materials;

• Press and public relations work, editorial contributions, presentations, trade fair and event appearances, and internal communication.

The exclusive right of use includes, in particular, the right to reproduce, distribute, exhibit, make publicly available, publicly perform, transmit, and store the photos in databases or media archives. The participant retains the right to use their photos for purely private purposes but may not grant the commercial usage rights to any third party without the consent of Alfsee GmbH.

Alfsee GmbH is permitted to technically and creatively edit the photos for the aforementioned purposes, in particular to adjust size, format, file type, color space, brightness, contrast, sharpness, and image cropping, to integrate them into layouts, and to combine them with text, logos, or graphic elements. Editing that distorts the meaning, is derogatory, or alters the essential content of the image is prohibited.

Alfsee GmbH may transfer the necessary usage rights for implementation to commissioned agencies, technical service providers, printing companies, platform operators, and media partners, or grant them corresponding sublicenses, provided that they act exclusively on behalf of or in connection with the communication of Alfsee GmbH. Independent use for third-party purposes is not permitted.

Attribution will be made, insofar as it is customary and technically feasible in the respective medium, using the name provided during registration or an agreed-upon short name. Participants may inform Alfsee GmbH that they do not wish to be named. Statutory rights of withdrawal and termination remain unaffected.

8. Right to one's own image and revocation of consent

The granting of copyright rights according to section 7 does not replace the necessary consent of recognizably depicted persons. By uploading, the participating person confirms that all recognizable persons have been clearly informed in advance about the advertising purposes, media, spatial and temporal scope, and possible editing mentioned in section 7 and have consented to publication. In the case of minors, all necessary legal guardians and – depending on age and capacity for understanding – the child themselves must also have given their consent.

Alfsee GmbH may request written or electronically documented proof of these consents before publication. If such proof cannot be provided, Alfsee may exclude the photograph from participation, not publish it, or obtain its own release from the individuals depicted.

Data protection or image rights consent can be revoked by the person depicted with effect for the future. The lawfulness of the processing carried out until the revocation remains unaffected. After a valid revocation, Alfsee GmbH will cease all future uses of the image in question that are controlled by Alfsee to the extent technically and organizationally feasible. Printed materials already distributed, completed campaigns, or copies outside the control of Alfsee GmbH cannot always be completely withdrawn. The photographer's copyright rights remain unaffected; however, the photograph may no longer be used in a manner that infringes the validly revoked image rights.

9. Profit Determination

After the submission period has ended, a jury appointed by Alfsee will review all valid entries and select ten winning designs. The selection will be based on the following pre-announced criteria: recognizable Alfsee connection, authenticity, visual impact, originality, emotional message, and technical usability. The criteria will be evaluated holistically; there is no guarantee of a specific ranking.

The ten winning designs will be selected across all categories. There is no guarantee that a winning design will emerge from each category, nor is there a specific distribution of prizes across the categories.

The jury's decision is final. Legal recourse is excluded with regard to the subjective jury evaluation; mandatory legal rights and judicial review of legal violations remain unaffected.

10. Winnings, notification and settlement

Ten vouchers from Alfsee GmbH, each worth €100, will be given away. Each person can win a maximum of one prize.

Voucher terms and conditions: 

The ten winners will each receive a voucher from Alfsee GmbH worth 100.00 euros.

The vouchers can only be redeemed for services provided by Alfsee GmbH in the following business areas:

• Camping,
• Rental accommodations in Germanenland,
• Apartments,
• Alfen Saunaland,
• Ringhotel Alfsee Piazza,
• Restaurant Feingeist.

For camping stays and bookings in Germanenland and apartments, redemption is also possible online. For this, the voucher code must be entered in the designated field during the booking or payment process. The voucher can also be redeemed on-site in all the aforementioned business areas.
Redemption for services of other companies or external operators at Alfsee is excluded. This also applies if their offers are presented or brokered via the Alfsee GmbH website.

The vouchers are valid until and including December 31, 2029. After this date, they can no longer be redeemed.
Partial redemption is possible. Any remaining balance will remain on the voucher until December 31, 2029, and can be used within this period for other redeemable services offered by Alfsee GmbH. Cash payment or interest on the voucher value or any remaining balance is excluded.

The vouchers are personalized and non-transferable. They may only be redeemed by the respective winner. Alfsee GmbH is entitled to request suitable proof of identity upon redemption.

The voucher can also be used for an existing booking, provided it has not yet been fully paid. Redemption must be requested online or by contacting Alfsee GmbH with the voucher code before completing full payment. Retroactive application to fully paid or completed bookings, as well as retroactive refunds of payments already made, are not possible. If the price of the booked or used service exceeds the available voucher balance, the winner must pay the difference.

Cash payment or interest on the voucher value is excluded. Winners are responsible for any additional costs associated with using the voucher, in particular travel, meals, and services exceeding the voucher value.

The winners will be notified by email to the address provided during registration. They must confirm their win within 14 calendar days of receiving the notification and provide the necessary information for processing. If no response is received within this timeframe, or if delivery is not possible despite reasonable efforts, Alfsee GmbH reserves the right to revoke the winning entry and select a replacement based on the same criteria.

The public announcement of a name will only occur with explicit consent. Without such consent, Alfsee may publish the winning photo anonymously or under an agreed-upon short title, based on section 7.

11. Exclusion and subsequent revocation

Alfsee GmbH may exclude submissions or individuals from the competition for a legitimate reason. This applies in particular to false or incomplete information, multiple entries, attempted manipulation, automated submissions, violations of these terms and conditions, lack of rights or consent, and unlawful content. Before exclusion, Alfsee GmbH may set a reasonable deadline for clarification or submission of supporting evidence, provided this is reasonable given the nature and severity of the violation.
If a reason for exclusion only becomes apparent after the winner has been determined, the prize may be revoked and – if already awarded – reclaimed in accordance with legal regulations.

12. Modification, Interruption or Termination

Alfsee GmbH may modify, suspend, or prematurely terminate the photo competition for good cause if its proper execution can no longer be guaranteed for technical, legal, or factual reasons. This includes, in particular, significant technical malfunctions, manipulation, security incidents, or mandatory official or legal requirements. Changes must not unreasonably disadvantage participants. Existing legal claims remain unaffected.

13. Liability

In the event of a slightly negligent breach of a material obligation arising from the execution of the photo competition, Alfsee GmbH shall only be liable for typically foreseeable damages. Material obligations are those whose fulfillment is essential for the proper execution of the photo competition and on whose compliance participants may regularly rely.
Otherwise, liability for damages caused by slight negligence is excluded. These limitations of liability do not apply in cases of intent or gross negligence, damages resulting from injury to life, body, or health, or in cases of mandatory statutory liability. They also apply accordingly to the legal representatives and agents of Alfsee GmbH.

14. Data protection

For the purposes of this competition, the following data will be processed: name, email address, submitted photos, category, optional image description, declarations and proof of consent, and technical transmission data. The processing necessary for participation is carried out for the purpose of conducting the free competition in accordance with Article 6(1)(b) GDPR. Publications of identifiable individuals and, where applicable, their names, will be based on separate consent in accordance with Article 6(1)(a) GDPR and Section 22 of the German Copyright Act (KunstUrhG). This consent can be revoked at any time with effect for the future. The lawfulness of the processing carried out until the revocation remains unaffected.

Only employees entrusted with the execution of the data and necessary technical service providers have access to it. Where legally required, data processing agreements are concluded with service providers. When content is published on social networks, data may be transferred to the respective platform operators and potentially also to third countries. Further information on this can be found in the privacy policy of Alfsee GmbH.

The participation and contact details of non-winning individuals will generally be deleted no later than six months after the photo competition has been fully completed, unless legal retention obligations or legitimate interests for evidence or defense justify longer storage. Submitted photos, documentation of the granting of rights, and required consent documents may be stored for the duration of the rights grant, insofar as Alfsee GmbH uses the photos for the purposes stated in section 7 or specifically intends to use them. The contents of the image archive and the continued necessity of storage are reviewed regularly. Data of the winners will be stored in accordance with statutory commercial and tax law retention requirements.

Under the GDPR, data subjects have, in particular, the right to information, rectification, erasure, restriction of processing, data portability, and objection. Where processing is based on consent, this consent can be withdrawn at any time with effect for the future.

15. Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). With respect to consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence.

Should any provision of these terms and conditions be or become invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by the applicable statutory regulations. There is no obligation to participate in dispute resolution proceedings before a consumer arbitration board.
